Official Contest Rules

1. The Marty’s Toy Box Contest (“Contest”) is open to any individual eighteen (18) years of age or older in the KBIQ broadcast listening area who registers by completing an official entry form at one of the following locations during normal business hours:

Each entrant may complete only one entry per person per location per day.  Employees, officers, directors, agents, representatives, and immediate family and household members of Bison Media, Inc. (“Radio Station”), its parent company, its parent’s affiliated companies, and its advertising and promotion agencies are not eligible to participate in the Contest.

2. There will be fifty-two (52) Finalists.  Each Friday between November 13, 2009 and December 18, 2009 at 8:00 a.m., 10 entries will be selected by random drawing from among all eligible entries received by 12:00 noon on the previous Thursday (the drawing for Thanksgiving week will be Saturday and the cutoff for entries will be 12:00 noon Saturday November 28, 2009).  On December 19, 2009 at 12:45 p.m. (subject to change) two (2) entries will be selected from among all entries received between 11:30a.m. and 12:40 p.m. (subject to change) at Chick-fil-A on 575 Garden of the Gods Road (“Final Finalists”).  Final Finalists must be present to be a Finalist and entered into the Grand Prize drawing.  If a Final Finalist entrant is not present when their entry is drawn the entry will be void and another entry will be selected until 10 Final Finalist entries are present.  An entrant may only be selected as a Finalist once and any additional entry forms drawn will be void in the Finalist drawings and Final Finalist drawing and an alternate entrant will be selected.  Finalists will be notified by e-mail, regular mail, or telephone within one (1) week from the date of selection.

3. There will be one (1) Grand Prize winner.  The Grand Prize winner will be selected by random drawing on December 19, 2009 at approximately 1:00 p.m. (subject to change) after the Final Finalist drawing is concluded from among all Finalists present at Chick-fil-A on 575 Garden of the Gods Road.   When the Finalist entry is announced they will have 30 seconds to claim the prize.  If a selected Finalist does not claim the prize within 30 seconds of being announced, an alternate Finalist entry will be selected and the process repeated.  Once a Finalist claims the prize within the 30 second window the contest will be over.  The winner will be notified at the time of winning.  The winner must complete an affidavit of eligibility and liability and, where lawful, publicity release.  If Radio Station does not receive the affidavit and release within two (2) weeks of notification, the prize may be forfeited and an alternate winner may be selected.  Except where prohibited by law, by signing the affidavit and release, the winner grants permission to the use of his/her name, likeness, picture, portrait, hometown, service mark, voice, biographical/other information, and statements for advertising and promotional purposes for this and other promotions by Radio Station without additional compensation.  The prize will be awarded within approximately two (2) weeks after all required proof and documentation is received.  The Grand Prize winner has until September 30, 2010 to redeem the prize or the prize will be void.  Odds of winning depend on the total number of entries received.  Radio Station is not responsible for lost, late, damaged or mishandled entries.

4. There is one (1) Grand Prize:  Round trip airfare from Denver to Los Angeles International Airport, round trip shuttle transportation between Los Angeles International Airport and the hotel, 2 nights accommodations for 2 adults 2 children, 4 one day “Park Hopper” all age passes (“Grand Prize”) with an approximate retail value of $2,500.  Reservations need to be made a minimum of 45 days prior to the anticipated departure date and are subject to availability, blackout dates may apply.

5. No transfer, substitution, or cash equivalent will be given for the Grand Prize, provided however, Radio Station may, at its sole discretion, substitute a prize of equal or greater value.

6. By participating in the Contest, each entrant agrees to abide by and be bound by all of these Official Contest Rules and the decisions of General Manager of Radio Station ("Contest Judge").  All decisions regarding the Contest including, but not limited to, selecting the winner, will be made by the Contest Judge, whose decisions shall be final.  The Contest Judge may prohibit an entrant from participating in this Contest, in his/her sole discretion, if, in the opinion of the Contest Judge, the entrant fails to abide by these rules, or otherwise acts (i) in a non-professional or inappropriate manner, (ii) with an intent to annoy, abuse, threaten, or harass any other entrant or Radio Station, its parent company, its parent’s affiliated companies or its advertising and promotion agencies, or (iii) in any other disruptive manner.  The winner is solely responsible for all applicable federal, state, and local taxes, and may be required to complete a W-9 taxpayer identification form.  All federal, state, and local laws apply.  By participating in the Contest, each entrant agrees to release and hold Radio Station, its parent company and its parent’s affiliated companies harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on any libel, slander, illegal competition or trade practice, violation of rights of privacy, infringement of copyrights or other rights of third parties.
